We are in danger of repeating the same mistakes if we bemoan low attention to ‘facts’

A key theme of some of the early analysis of Brexit is that many voters followed their feelings rather than paying attention to facts*.

For some people, this is just a part of life: to describe decision-making as ‘rational’ is to deny the inevitable use of heuristics, gut feelings, emotions, and deeply held beliefs.

For others, it is indicative of a worrying ‘post-truth politics’, or a new world in which campaigners play fast and loose with evidence and say anything to win, while experts are mistrusted and ignored or excluded from debates, and voters don’t get the facts they need to make informed decisions.

One solution, proposed largely by academics (many of whom are highly critical of the campaigns) is largely institutional: let’s investigate the abuse of facts during the referendum to help us produce new rules of engagement.

Another is more pragmatic: let’s work out how to maximise the effectiveness of experts and evidence in political debate. So far, we know more about what doesn’t work. For example:

  • Don’t simply supplypeople with more information when you think they are not paying enough attention to it. Instead, try to work out how they think, to examine how they are likely todemand and interpret information.
  • Don’t just bemoan the tendency of people to accept simple stories that reinforce their biases. Instead, try to work out how to produce evidence-based stories that can compete for attention with those of campaigners.
  • Don’t stop at providing simpler and more accessible information. People might be more likely to read a blog post than a book or lengthy report, but most people are likely to remain blissfully unaware of most academic blogs.

I’m honestly not sure how to tell good stories to capture the public imagination (beyond that time I put the word ‘shite’ in a title) but, for example, we have a lot to learn from traditional media (and from some of the most effective academics who write for them) and from scholars who study story-telling and discourse (although, ironically, discourse analysis is often one of the most jargon-filled areas in the Academy).

We have been here before (in policy studies)

This issue of agenda setting is a key feature in current discussions of (the alleged lack of) evidence-based policymaking. Many academics, in areas such as health and environmental policy, bemoan the inevitability of ‘policy based evidence’. Some express the naïve view that policymakers should think like scientists and/ or that evidence-based policymaking should be more like the idea of evidence-based medicine in which there is a hierarchy of evidence. Others try to work out how they can improve the supply of evidence or set up new institutions to get policymakers to pay more attention to facts.

Yet, a more pragmatic solution is to work out how and why policymakers demand information, and the policymaking context in which they operate. Only then can we produce evidence-based strategies based on how the world works rather than how we would like it to work.

The land of “neverendums”. For the Swiss, direct democracy is a way of life, but could it work in the UK?

Next week, voters across the UK will finally make their decision on the country remaining in or leaving the European Union. This is only the third UK-wide referendum ever to be held. The first was in 1975, on Britain’s membership of the European Economic Community. The second took place in 2011, on a new voting system to replace first-past-the-post.

Although referendums in different parts of the UK have become more commonplace – such as those on the 1998 Good Friday Agreement in Northern Ireland and on Scottish independence in 2014 – they are much less frequent at UK level. This is because of the UK’s tradition of representative democracy, where sovereignty rests with parliament. In Switzerland, however, representative democracy runs parallel to a system of direct democracy, which gives voters the last word on legislation.

The Swiss system

Of all the national referendums held in Western democracies since World War II, more than two-thirds have been held in Switzerland. Swiss voters go to the polls three or four times a year, deciding on issues as varied as immigration, complementary medicine, and financing of local sports facilities. Swiss referendums may be triggered in several different ways:

  • Obligatory referendum (following a constitutional amendment or an application to join an international organisation, such as the United Nations or the European Union)
  • Optional referendum (puts parliamentary decisions to the popular vote, but only if 50,000 valid signatures are collected within three months)
  • Popular initiative (proposers have 18 months to collect 100,000 signatures to force a vote on a particular issue)
  • Counter proposal (if parliament disagrees with a popular initiative, it can put forward alternative. Both votes are held at the same time, and if both are approved, the one with the highest number of “yes” votes is the winner)

As one writer on Switzerland has observed,

“…the Swiss people are the final decision-makers on almost every single policy, whether it affects their own neighbourhood or the whole country. This democratic freedom and the right to be heard are inalienable rights for the Swiss, who proudly view them as the source of their stability and prosperity.”

More referendums in the UK? The arguments for and against

On the face of it, any political system which encourages greater citizen participation is to be applauded. Proponents of referendums argue that they are exercises in civic engagement, stimulating debate and increasing interest among people who would usually show no interest in politics.

A good example, in a UK context, is the 2014 referendum on Scottish independence. The campaign energised voters across the country and the poll itself saw a historic turnout of 84.6%. Despite being on the losing side, both the Scottish National Party and the Scottish Green Party reported a surge in membership in the aftermath of the referendum result.

Supporters of the wider use of referendums also believe they can provide a mandate for specific policies, such as the Republic of Ireland’s vote supporting equal marriage in 2015, and can legitimise important constitutional issues, such as devolution.

However, opponents of the referendum as a democratic tool contend that the issues debated during referendum campaigns can’t be decided by a simple binary choice, or are too complex for the public to understand. Professor Richard Dawkins, the evolutionary biologist, has argued that the UK’s membership of the EU should be decided by elected officials with a sound understanding of the major economic issues:

“It is an outrage that people as ignorant as me are being asked to vote. This is a complicated matter of economics, politics, history, and we live in a representative democracy not a plebiscite democracy. This should be a matter for parliament.”

A recent leader article in The Economist noted that referendums may be used by fringe groups or populist parties to exercise outsize influence. In recent years, the nationalist-conservative Swiss People’s Party (SVP) has gained enough signatures to force referendums on issues such as the construction of new minarets for Swiss mosques and the imposition of quotas on immigration. Some in Switzerland believe that these campaigns have damaged the country’s image and incited hostility towards ethnic minorities.

In addition, a narrow decision can raise questions about the legitimacy of the result. The slim margin (50.4%) of Swiss voters supporting immigration quotas in 2014 make it more likely that the country will be asked to vote on the issue again. This could be problematic, with voters potentially becoming fatigued or apathetic if they are asked to vote too often. In the Swiss case, the average voter turnout for all 10 of the elections and referendums held in 2014-2015 was 50.1%, although turnout fluctuated between a high of 63% and a low of 42%.

Final thoughts

For some, the EU referendum campaign has shown up the deficiencies in the use of referendums to make momentous decisions – conjecture, claims, counter-claims and inconclusive arguments. For others, it has been an important exercise in direct democracy, giving the people a chance to debate an issue of vital importance to the entire country.

Unlike Switzerland, the UK has an unwritten constitution, and there are no rules on what can trigger referendums. Only in rare cases have British governments put a single issue to the people, a feature of UK politics that is set to continue. Whatever the outcome of next week’s vote, it’s unlikely that the UK will move towards the Swiss system of direct democracy.

Since the 2012-13 financial year, council tax increases beyond the government’s limit can trigger local referendums. But are they having an impact on policy?

The Council Tax: before and after localism

Local government spending in Great Britain is paid for by three main sources:

  • central government
  • business rates
  • council tax

The council tax pays for about a quarter of all local services. However, cuts in funding from central government have put pressure on local authorities trying to maintain and improve services. As a result, in recent years many councils have been forced to impose council tax rises. This in turn has generated opposition from local residents and charges from central government that the increases are excessive.

Previously, if ministers believed that local authorities were increasing taxes excessively they had the power to cap council tax rises. However, in 2010, the Conservative general election manifesto promised to give residents the power to veto excessive council tax increases. The measure was included in the coalition government’s programme for government and introduced in the Localism Act of 2011.

The thresholds for council tax rises

The Localism Act, which applies only in England, gives local communities the power to decide on council tax increases above a certain limit.  The Secretary of State for Communities and Local Government determines this limit, which has to be approved by the House of Commons.

If a local authority proposes to raise taxes above the limit they must obtain approval from local voters in a referendum.

For the 2016-17 financial year, the government proposed the following thresholds:

  • local authorities with social care responsibilities – 4% (an extra 2% to fund social care)
  • district councils, Police and Crime Commissioners (PCCs), fire and rescue authorities and the Greater London Authority (GLA): 2%
  • Districts and PCCs whose council tax level is in the lowest quartile of their type of authority may raise council tax by up to £5.00 on a Band D bill (which may be a greater rise than 2%).

This means, for example, that a local authority with social care responsibilities wishing to raise its council tax above 4% would have to organise a referendum on the proposed increase. In addition, the authority would have to make substitute calculations that would take effect if the proposed increase is rejected in the referendum.

Triggering a referendum

In March 2016, a survey by the Chartered Institute of Public Finance & Accountancy (CIPFA) found that many councils are set to increase council tax close to the 3.99% maximum allowed under the referendum cap.

Few councils have so far set council taxes at a level that would trigger a referendum.

In 2015, the Green Party on Brighton and Hove Council failed to secure backing from the other parties for a 5.99% council tax rise. A settlement of 1.99% was eventually agreed, but the Greens said a bigger rise would have helped protect services for the elderly, adults in care, children and those living below the poverty line.

Bedfordshire says “No”

In May 2015, residents in Bedfordshire became the first in the country to vote in a referendum triggered by a decision to raise the council tax. The county’s Police and Crime Commissioner, Olly Martins, increased the amount of the council tax for Bedfordshire Police by 15.84% compared to the previous year. He claimed that the increase would provide funds for more police officers.

However, the rise was rejected by almost 70% of voters, and the council had to issue new bills based on the lower increase of 1.99%.

Mr Martins said the result would mean a reduction of up to 135 uniformed officers from the existing 1,067. He also raised concerns about the rules on the wording on referendum ballot papers and awareness-raising during the campaign.

But Richard Fuller, the Conservative MP for Bedford claimed that the £350,000 spent on holding the referendum, and the £250,000 for re-billing meant that Mr Martins had shown “incredibly poor judgement”.

Here to stay

With only one council tax referendum to consider, it’s still too early to assess the impact such polls may have on policy. However, the costs and time-consuming nature of organising referendums of this kind may be acting as a deterrence to raising council tax bills above the referendum cap.

The government remains committed to the policy of council tax referendums, and has suggested that it could be extended to parish councils. In March 2014, the Labour Party confirmed that there were no plans to abolish the referendum principles. However, there is no guarantee that this will be the party’s policy going into the next general election.

For the foreseeable future, council tax referendums are here to stay.
