A mixed reception for Labour’s housing green paper

 

In April, the Labour Party launched its strategy for tackling the housing crisis in England. Housing for the Many presents a 50-point plan, with proposals that include:

  • investing £4bn a year to build one million ‘genuinely’ affordable homes over 10 years
  • lifting of council borrowing caps
  • removing the ‘viability loophole’, making it impossible for developers to dodge their affordable housing obligations
  • zero tolerance of developments without any affordable housing provision
  • a stricter definition of affordable housing
  • scrapping the ‘bedroom tax’
  • suspension of ‘right to buy’
  • cut-price government loans for housing associations
  • protected housing benefit for under 21s
  • consideration of mandatory space requirements
  • a new generation of garden cities and new towns

Following its publication, analysts in the housing and property sectors gave their thoughts on the strategy.

More affordable homes

The most ambitious proposal is the plan to build 100,000 homes each year.

For Emily Williams, associate director at Savills, this proposal was the most eyecatching:

“The emphasis on investing to deliver more homes to solve the housing crisis, rather than relying on housing benefit to support people who can’t access market housing, is something we have been talking about for a long time.”

However, Savills estimates that the £4bn figure is insufficient for Labour to hit its one million homes target, suggesting that a further £3bn would be needed.

Elsewhere, Carl Dyer, partner in Irwin Mitchell solicitors expressed concern about where the money would come from:

“After Labour’s last 13 years in power from 1997 to 2010, their out-going Chief Secretary to the Treasury famously left a note for his successor: “Sorry, there’s no money”. There is still no magic money tree, and no indication here how these homes are to be funded.”

Developers

Labour’s policy of no development without affordable housing has raised concerns in the property industry.  Justin Gaze, head of residential development at Knight Frank told Property Week that the proposals risked deterring developers from undertaking new projects:

“There will be instances where affordable housing cannot be provided, for example on conversions of some buildings where it’s difficult to deliver both open-market and affordable housing side by side.”

The land market

One of the less reported proposals caught the eye of Luke Murphy, IPPR’s associate director for the environment, housing and infrastructure. Writing in CityMetric, Murphy highlighted the proposal to create an English Sovereign Land Trust that would allow local authorities to buy land at cheaper prices to build affordable homes.

“It is here, through intervention in the land market, that the state could have the biggest impact – not to just build more affordable homes, but to make all new homes built more affordable.”

But he argued there was still room for improvement:

“… on land reform, there is scope to be bolder and go further to ensure that affordable housing really is available ‘for the many’, rather than the preserve of the few.

Redefining affordability

The Royal Institution of Chartered Surveyors (RICS) commented on Labour’s proposal to redefine affordable housing to relate it to average incomes rather than housing as a percentage of market rates:

“This makes sense as a measure of affordability, however, this will likely lead to a trade-off between affordability and the numbers of affordable homes delivered, unless capital grants are available at the outset, geared to the income segment to be accommodated.”

RICS also welcomed the plan to lift council housing borrowing caps.

“This is certainly something RICS has been calling for, however appropriate measures must be taken to ensure that local authorities do not expose themselves to too much risk.”

Benefits reforms

The Chartered Institute of Housing wondered whether Labour would reform the benefit system to bring it closer into alignment with housing policy:

“Of course, abolishing the bedroom tax will help, but tenants’ ability to pay their rent if they are on low incomes is now under assault from the whole range of welfare reforms, of which bedroom tax is only one.”

Final thoughts

The housing crisis has been decades in the making, and there is no quick fix for tackling the problems of housing shortages, affordability and homelessness. Just last month, research by Heriot-Watt University found the chronic shortage of housing in the UK was greater than first thought, amounting to four million homes. To meet the backlog, the researchers estimated that the country needs to build 340,000 homes a year until 2031. This is significantly higher than the targets set both by the Conservative government and the Labour Party.

The new green paper from Labour has presented clear alternatives to the government’s housing policies, and later this year the government is set to publish its own green paper on social housing. The debate will continue, and housing will remain high on the political agenda.

Scotland’s High Line: Bowling basin redevelopment

Pre-2014, the Bowling harbour basin at the western entrance to the Forth and Clyde Canal had seen better days. The decline of what was a hub of activity in its industrial heyday had left it largely unused, neglected, and in need of some TLC. The Bowling basin harbour development, headed by Scottish Canals and West Dunbartonshire Council, has been breathing new life into the area through a regeneration programme which includes the development of housing, retail units, a cycle path and most recently plans for a “high line” park inspired by the New York model.

To date, more than £3.2 million has been invested in the project, which has included the transformation of disused railway arches into commercial business space and landscaping improvements to the lower basin area.

Designing with – not just for – the community

In 2014 a charrette was held (which its self was praised as excellent practice in local level co-production and co-design) in which residents and other stakeholders were invited not only to consult on plans for the regeneration, but to put forward their own ideas for what could potentially be done with the site and develop a shared master-plan for the area.

Partnership and co-production, as well as wide engagement across stakeholder groups were seen as central to the charrette process, and the transparency and regular engagement with local residents has ensured that the development not only meets the economic development needs set out by the council and Scottish Canals, but that it also fulfils the aspirations of local people.

A destination in its own right

One of the primary aims of the Bowling development was not just to rejuvenate the area, but to make Bowling a leisure and tourist destination in its own right. Retail units have been created within the refurbished arches of the railway bridge. Re-landscaped areas, to be developed into nature preservation sites, have been delivered, along with infrastructure which connects the harbour to the surrounding villages, the rest of the canal network, and the cycle network towards the Trossachs and Glasgow.

Most recently, an activity hub has been opened which includes opportunities for cycling, water sports and event space for clubs to meet, as well as “The Dug Café”, a dog friendly coffee shop. It is hoped the offering of retail, outdoor activities and connectivity to the rest of the canal network, as well as Glasgow will encourage more people to visit Bowling. It is also hoped the project will act as a new focus point for members of the community, linking to schools and employment opportunities for local people and businesses.

Scotland’s High Line

The New York High Line is a 1.45-mile-long linear park which runs through Manhattan on the former New York Central Railroad. In October 2017, proposals were submitted for planning approval for Bowling’s very own high line, using the iconic 120-year-old swing bridge. The railway fell into disrepair in the 1960s, but with funding support from Sustrans and Historic Environment Scotland, Scottish Canals has undertaken repairs to the structure’s metalwork and repainted the entire span. The plans include new viewpoints which will offer visitors the chance to enjoy the vistas over the canal and River Clyde. The new route will form a direct link between the Forth & Clyde Canal and the National Cycle Network route heading towards Loch Lomond and The Trossachs National Park.

Looking to the future…

Scottish Canals are keen to stress the potentially vial role they can play in revitalising Scotland’s waterside environments. With a large landholding and significant scope for supporting regeneration projects, they are becoming an increasingly major player. They view the areas along Scotland’s canal network as opportunities not only to use innovative techniques such as custom build projects to improve the physical environment around waterways and canals, but also to support and create positive places and opportunities for local communities.

Scottish Canals are also involved in developments at Dundas Hill in Glasgow, as well as a number of projects across the canal network in Scotland.

Housing models for the future

Housing is one of the challenges of our time. The task for architects and designers is to create affordable, robust housing that can accommodate the needs of a rapidly growing, but also ageing population. And it’s not as easy as simply building. The demands and expectations on house builders to also be community builders and the architects of mental and physical wellbeing through design have led architects and designers to consider alternative ways to house us in the future. This includes innovative use of materials and construction methods, addressing the issue of financing through co-operative living models and using bespoke design to create lifetime homes which can be adapted to accommodate the changing needs of our population.

Large-scale development

One of the big challenges for urban areas is large-scale development strategies for designing and delivering housing to meet need. For developers and planners going forward there are a number of factors to consider: the type of investment introduced to an area; how the schemes fit with a wider development plan for the city; and the importance of engaging the community in any plans to develop or regenerate an area.

“Placemaking”, not just house building is central to large scale development discussions, emphasising to planners, architects and developers the fact that they are not just building houses, but creating communities. As a result, designers and developers should be mindful of their important role in community building, to build the right sort of homes in the right places, at affordable prices and with a legacy in mind. They should, create high quality, long lasting units, which will stand the test of time but that also can be easily adapted to accommodate people’s changing needs.

Alternative construction and design

Innovative models and options for future builds have been discussed for a number of years but they are becoming an increasingly mainstream way to build affordable housing that meets the current need, particularly of students and young professionals, and of older populations looking to downsize or move into assisted care accommodation.

Offsite manufacture or modular homes  Offsite manufacture of timber framed houses is becoming increasingly common, with the constituent pieces of the house manufactured off site, then transported to the site and constructed on a concrete block where foundations and services such as plumbing have already been created. Offsite housing can either be open panel, which requires the finishing such as bathroom and kitchen installation to be done on site, or closed panel which provide the entire section complete with decoration and flooring (this is becoming a common way to build cheap, efficient student housing).

Custom build  Custom build projects are similar to self-build in that they give clients flexibility to select their own design and layout, However, custom build provides slightly more structure and certainty which can make it easier when considering elements like financing and planning applications. In essence, customers select the spec of their house in the same way they might make custom modifications to a car.

Build to rent  This model has been adapted from the United States, where build to rent is popular. The model is based on self-contained flats, with central and shared amenities, entrance and communal space. Designed to attract graduates and young professionals, these are being increasingly designed using a “user first” approach. Developers identify the sort of person they want to live in the development, identify what sort of things they might look for in a development, including floor type, furniture, layout, amenities, gadgets, and then build the development around that.

Dementia friendly – Building homes that are safe and affordable, but allow for independence in old age, is one of the major demands on house builders currently. Housing stock is seen as not suitable for current need, but building bespoke sites for people with illnesses like dementia has been seen as a bit of a niche previously. Virtual Reality (VR) is being used by some architects and developers to try to help them understand the needs and requirements of people with dementia and how they can build homes suitable for them to be able to live as independent and full lives as possible. Building dementia friendly homes not only means making them accessible and open plan, but also adapting the layout, adding signage where appropriate and if possible locating the homes within a wider community development. Dementia villages like those seen in Amsterdam are being used as the model for this.

Co-housing

Co- housing offers an alternative to communities in Scotland, and while lessons can be learned from elsewhere in Europe, where co- housing models have been successful, there are also pockets of good and emerging practice in the UK too. More traditional examples include Berlin, where almost 1 in 10 new homes follow the Baugruppe model, and Amsterdam (centraal wonen) where some of the oldest co-housing projects originate. In Denmark, 8% of households use co-housing models.

Co-housing provides the opportunity for groups of people to come together and form a community which is created and run by its residents. Each household has a self-contained, private home as well as shared community space. Residents come together to manage their community, share activities, and regularly eat together. A “Self-build Cooperative Group” is a joint venture between several private households who plan and build their own house together. Usually they are supported by an architect. Often co- housing groups are able to realise high-quality living space at prices below local market rates, although it is not really considered suitable for large-scale development within the current UK market.

Opportunities for a new way forward

Practitioners are often challenged to push the boundaries of design and building in their field. Looking to new models for future building design provides an opportunity to think creatively about alternative uses of materials and space and to consider options for construction, funding and investment in the built environment that challenge the norm. Learning lessons and exchanging ideas from elsewhere, architects and planners have the opportunity to come together to consider how the built environment in Scotland can help to create places  not just buildings  and how this can contribute positively to the wider wellbeing and happiness of people living in Scotland in the future.

Predominantly set within environmentally attractive surroundings, historic towns and cities have a strong sense of place, offer a good quality of life, are often prosperous and represent models of sustainable development.

Research shows that businesses based in older places are more productive than the average for all commercial businesses across the whole economy. Retail and leisure businesses often seek to cluster in historic areas of towns and cities, and historic buildings are particularly attractive to new business start-ups, especially in the creative and cultural sector. Well-maintained historic places also enhance cultural life and community resilience.

As a result, historic towns are much sought after places to live and work, which has contributed to unprecedented growth.

Growth pressures

While growth is seen as a good thing for the future of town centres, managing it effectively in these areas of historic importance is not without its challenges. Older townscapes and buildings are a valuable and irreplaceable community asset that need to be protected.

Growth in historic towns creates pressure for new housing and development, and the infrastructure that is needed alongside it. It can also lead to increased congestion and depletion of suburban quality through redevelopment and loss of garden space. The traditional infrastructure in these towns may not be able cope with the increased capacity resulting in demand for suitable adaptation.

Managing these growth pressures is a particular challenge for historic towns as they need to try and meet local development need while both conserving the identity and sense of place of the existing town and nurturing the creation of sustainable new communities within them.

The Historic Towns Forum has highlighted that “there are challenges of infrastructure, partnership working, working with major national developers, the tension between modernity and pastiche and how to learn from the past and the present when building at this scale.”

In addition, the main political priority across all areas is economic wellbeing, taking precedence over any heritage considerations. A report from Green Balance in 2014 found that this principle concern was interpreted differently from place to place, with some local councillors viewing heritage as beneficial to a town’s economic and social wellbeing, while others viewed it is a burden and drag on investment.

As the heritage of places can be a particular pull for tourism, not preserving them could lead to a loss in economic wellbeing. The importance of achieving the right balance between sustainable development and heritage conservation is a theme that has been consistently highlighted in the research.

Smarter growth

So how do such places manage growth while also safeguarding both the character of the towns themselves and the settings around them?

According to the Historic Towns Forum, key issues in effectively addressing growth pressures in historic towns include:

  • planning and process;
  • partnerships;
  • finance and economics;
  • climate change;
  • community benefits and community engagement;
  • design; and
  • learning from the past and present.

It has been argued that a strategic approach to growth needs to be taken, such as the approach taken in Cambridge, where the Cambridgeshire Quality Charter for Growth is being used to help steer the creation of high quality sustainable communities.

Partnerships involving a range of local stakeholders, encompassing a shared vision and cooperation are also important for effective growth. Where strategic resources are lacking, which is often the case in smaller towns, community engagement can be of particular importance, as shown in Cirencester.

Key principles of good design have been highlighted to include:

  • learning from the past, including study of appropriate models;
  • localising by understanding local conditions; and
  • transforming action by applying appropriate, robust advances.

The overarching message seems to be that ‘smarter growth’ is required.

Good practice

There are examples of good practice where historic towns are managing growth in a way that protects their heritage. Cambridge, as mentioned previously, is one example. Sutton is another, where the challenges of growth are being addressed through the use of a Heritage Action Zone. The aim here is to balance growth with the management of heritage assets, providing lessons for elsewhere.

It is also important to look further afield. The historic town of Amersfoort in the Netherlands has been presented as a good model for managing housing growth to achieve attractive new settlements and create balanced communities. It has been suggested that this smarter approach is something that historic towns in the UK can learn from.

Another good example is Freiburg in Germany. Although different in terms of development to Britain, some of the issues applicable to British towns and cities have been addressed – including how to attract families to live at higher densities close enough to city centres to avoid car dependency.

As Historic England states:

“Learning is central to sustaining the historic environment. It raises people’s awareness and understanding of their heritage, including the varied ways in which its values are perceived by different generations and communities. It encourages informed and active participation in caring for the historic environment.”

Is it time to start building on the Green Belt?

The forthcoming Housing White Paper from the Department for Communities and Local Government is expected to tackle the thorny issue of the Green Belt. Initially due for publication at the end of 2016, the paper has now been delayed twice, heightening speculation about its contents.

The Telegraph has suggested that councils are likely to be encouraged to make greater use of the controversial policy of ‘green belt swaps’. Green Belt swaps allow councils to remove protections on one part of green belt in return for creating a new area of protected land elsewhere.  This may enable councils to better meet demand for housing.  Current planning legislation for Green Belt swaps already exists, but often fails to work in practice. Proposals are often rejected at the planning stage due to the newly identified land failing to meet Green Belt definitions. The Times indicates that the White Paper may contain a more aggressive approach towards the use of the Green Belt for housing.

Potential benefits

There is no denying the need for more housing.  In general, experts agree that a minimum of 200,000 new homes will be needed each year in order to keep up with demand.

Recent government statistics on Green Belt in England in 2015/16 estimated that it covered around 13% of the land area of England. It has been argued that development on just 1% of reclassified Green Belt would allow for almost half a million new homes to be built. However, building upon the Green Belt provokes much passionate debate.

Proponents of green belt flexibility argue that:

Paul Cheshire, Professor Emeritus of Economic Geography, LSE, argues that many opponents of building on the Green Belt hold a romanticised image of the nature of the land, which is not truly representative of the majority of Green Belt land.

“Of course parts of the Green Belts are real environmental and amenity treasures, such as the beautiful bits of rolling Hertfordshire, the Chilterns or the North Downs. Or rather, the beautiful bits to which there is public access. Such areas really need to be preserved against development. But almost all Green Belt land is privately owned, so the only access is if there are viable public rights of way.”

He goes on to suggest selective building on the least attractive parts of Green Belts, which are close to cities where people want to live.

A similar sentiment is found in the recent LSE report ‘A 21st Century Metropolitan Green Belt’. Dr Alan Mace, Assistant Professor of Urban Planning Studies at LSE (one of the authors of the report) concludes that:

“People often look at the Green Belt and say, ‘who would want to lose this?’ but often they’re looking at land that is protected in other ways, such as Metropolitan Parks or Areas of Outstanding Natural Beauty, and this would not change. Some parts of the Green Belt are neither aesthetically pleasing nor environmentally valuable and these are the areas that should be looked at for potential development.”

Potential limitations

However, Green Belt swaps are not without potential problems.  For example, Shelter has cautioned that Green Belt flexibility “could create a mini industry in speculative land trading in Green Belt areas, making cheap land release much harder as landowners hold out for high prices”.

There is also much opposition to building on the Green Belt among the general public and environmental groups. Paul Miner, planning campaign manager at CPRE, is concerned that the Green Belt is being chipped away, arguing that, among its benefits, the Green Belt:

“…continues to provide impetus for urban regeneration, and makes environmental and economic sense in protecting the breathing space around our towns and cities.”

Perhaps Rowan Moore, writing in the Guardian, neatly describes the desire of many to protect the Green Belt when he states “The fact that it is named in the singular, although there are many green belts, indicates its status as an idea, even an ideal, as well as a place. It is part of English, if not British, national identity, protected by the shade of William Blake”.

Future policy

The government has remained tight-lipped on the contents of the White Paper, but if they do choose to include Green Belt swaps as a key feature of the paper, they will face an uphill battle in tackling public perception and reassuring environmental and conservation groups.

Reconciling these differences of opinion will not be easy.  Ensuring that there is no overall loss in the total land area and overall quality of the Green Belt will no doubt be a key step towards addressing this.

Talking to children about poverty: why education needs to get in on the act

Scotland has one of the highest rates of child poverty in the UK. The latest figures from the Joseph Rowntree Foundation estimate that 1 in 5 children in Scotland live in poverty, with the figure rising to 1 in 3 in the urban centre of Glasgow. With more and more families falling into relative poverty and the numbers of working poor rising, the newly branded “JAMs” (just about managing) are, in some cases not managing, having to decide between heating their house or feeding their families.

People are affected by poverty in many different ways. For adults it can lower self-esteem, increase levels of stress, and can have consequences for mental and physical health. However, it’s sometimes forgotten that many children can feel these same effects from growing up in a family living in poverty.

In the same way as adults, many children suffer from low self-esteem and feel the invisible burden of the stigma that the label of “poverty” places on them. In addition, children affected by poverty:

  • are more likely to be victims of bullying;
  • tend to have lower attainment at school;
  • have fewer social networks or groups of friends;
  • suffer from poorer physical and mental health;
  • have less chance of leaving school with a full set of qualifications and going on to further or higher education (despite the best efforts of various governments to change this); and
  • are more likely than “affluent children” to spend their adulthood in poverty too.

How children understand poverty

Many children have an understanding of poverty as meaning “poor” or lacking in money. Concepts such as heating a home, building personal debt or not being able to afford to travel to work are not things they yet associate as being part of the cost of living, despite many of them seeing their own parents face these struggles on a weekly basis.

They associate poverty with foreign, particularly third world nations, as well as with homelessness, loneliness, a lack of familial support and a reliance on donations. Many children, even from the poorest backgrounds do not recognise themselves as being in poverty. This is something highlighted in research conducted by the Scottish Universities Insight Institute (SUII), which looked at child perceptions of poverty, and expressing these through alternate methods such as art.

In the study, children from schools in less affluent areas of Glasgow and Aberdeen were surveyed and many regarded notions of poverty as a distant, “third world” concept. However, when they were engaged in more creative methods, such as drama, or art, expressions of their experiences of poverty became more acute.

Engaging education professionals in the poverty discourse

In Scotland, the overarching framework of Getting it Right for Every Child (GIRFEC) is designed to bring services and professionals with whom children come into contact closer together to create a complete model of care for a child. It is interesting that in the latest commitment to tackling child poverty in Scotland there is no commitment to including teachers or education in general, in the same way as health professionals or social workers.

We know that poverty can have an adverse impact on wellbeing and on learning, and that children who live in poverty are more likely to be absent from school. However, education professionals are largely excluded from the discussions which child welfare officers, social workers, doctors and third sector colleagues are already having around the health and wellbeing of children who are living in poverty.

In a practical sense schools do, to a degree, already engage in reducing the impact of child poverty by providing financial and practical help. This could include subsidies for school meals or trips, the donation of free uniforms, breakfast clubs and tutoring after school classes. There have even been cases of individual teachers giving children clean clothes, meals or allowing them to sleep in the staff room at break and lunchtimes to allow them to catch up on sleep lost because of a disruptive lifestyle at home. However, talking about poverty with children is often neglected. This is something that academics are keen to see schools do more of – use their position to engage children in talking about poverty in order to help identify children at risk, but also to help raise the issue with other children who may not have experienced it or know what it is.

Using creative methods in schools to talk about poverty

Many academics argue that statistics on attainment can be misleading – while poverty has a significant impact, it does not correlate directly to cognitive ability. As one researcher at a seminar suggested, “just because you were born poor does not mean you were born without the ability to learn”. While there is evidence to suggest the slower development of children who live in poverty is acute in the early years, there is also evidence that the attainment gap is closing – what children in poverty miss out on is opportunity, variation and experience, and a chance to develop, rather than having lower overall cognitive function. This is one of the reasons, academics argue, it is so vital to engage teachers in wider discussions on child poverty.

For example, the vocabulary of children in poverty is often smaller in range than that of their more affluent peers. But, rather than this being the result of reduced cognitive function, researchers have found that this is primarily because they have not had the need to learn new words. Unlike children from more affluent backgrounds, they tend to remain within their community unit, using more colloquial language and a more limited number of words; they also often have less access to books or exposure to cultural experiences. That is not to say that they could not learn or have learnt all of the words that a child from a more affluent area knows; it’s just that they have not had the need or the opportunity to learn them yet. With this in mind, alternative methods of communication such as art, dance and storytelling could prove useful in explaining poverty to children, and helping them to discuss their experiences and understanding of what it means to be in poverty.

Using creative ways of communicating and engaging with children has already been found useful in helping them to talk about other issues personal to them, such as trauma or abuse. Researchers from the Scottish University Insight Institute-funded research team employed similar methods, using art, drama and play to help children express their feelings on poverty, and how it could be tackled in their communities. Children acted out scenarios, wrote poems, and created a number of pieces of tactile artwork, including sculptures and drawings. It was thought that these same methods could be used by teachers as a way to allow children to communicate their feelings about poverty and express issues relating to their own personal experiences without feeling stigmatised or singled out by other members of the class.

It is clear that the education profession has an important role, not only in helping to alleviate the effects of poverty on children through schemes like breakfast clubs, but also in a teaching and learning role. Many teachers and schools are averse to raise issues of money or poverty with children for fear of placing unnecessary distress onto children. However, sensitive and context-aware teaching on the issues around poverty should be seen as an opportunity, not a burden to teachers.

Effective discussion could go a long way to helping children to open up about experiences of poverty and also help them to be more understanding of other children who are living in poverty, reducing stigma and encouraging positive action within their local communities.

Delivering the value of planning: new report says stronger planning authorities will create better places

This month, the Royal Town Planning Institute (RTPI) has published a significant report suggesting ways in which good planning can deliver sustainable economic growth and tackle the country’s housing shortage.

Delivering the Value of Planning argues that properly resourcing councils’ planning teams, improving respect for planners and strengthening their influence, will lead to more and better development.

The challenges facing planners

The report contends that thirty years of almost continual changes in planning policy and regulation, along with cuts to local government budgets, has left the UK “incapable of consistently delivering good quality new places.”

The researchers also express concern about the widespread perception that planners act as a brake on new housing, economic growth and entrepreneurial activity:

Many changes have been informed by the flawed notion that planning has held back an otherwise efficient, self-regulating market that, if increasingly freed from its constraints, would be able to more rapidly deliver development.”

The impact of these challenges on planners themselves may be seen in the results of an RTPI survey, which found that:

  • nearly three-quarters (73%) think that constant changes to planning have hindered their ability to deliver good places;
  • more than half (53%) think that these changes have hindered housing development;
  • nearly 70% think that they are less able to deliver the benefits of planning compared to 10 years ago.

The report’s focus is on England, and the authors note that the policy debate around planning in Scotland, Wales and Northern Ireland has generally been more positive and constructive. But they observe that here too planning in many ways “remains under valued, under resourced and under used as a positive enabler and facilitator for development.”

Where planning works well

Throughout the report, the authors argue that effective and proactive planning can deliver considerable economic, social and environmental benefits for society, including:

  • providing clarity and confidence for investments;
  • improving the quantity and quality of land for development and construction;
  • delivering more and better housing development;
  • lowering the cost of overall development and opening up opportunities for new development.

To demonstrate the contribution of planning to the creation of successful places, the report showcases five award-winning developments in the UK:

  • Cranbrook in East Devon – a new community created by proactive planning set to provide 7,500 homes over the next 20 years;
  • Brindleyplace in Birmingham – an urban renewal development which has preserved the area’s heritage whilst revitalising it to attract new business and leisure uses;
  • Upton in Northampton – a high quality urban extension comprising 1,350 homes, with a commitment to exemplary urban design and environmental sustainability;
  • Norwich Riverside – a large regeneration project which has transformed a former industrial site into a successful major residential, retail and leisure development;
  • Fairfield Park in Bedfordshire – where the local authority has played a crucial role in shaping a high quality, attractive development with a strong sense of community and good facilities.

Rising to the challenge: what needs to be done

Delivering the Value of Planning says there is an urgent need to take stock of the UK’s planning systems, and to debate alternative futures that might produce better results. It advocates three key steps in this direction:

  • planners need to raise greater awareness about how better economic as well as social and environmental outcomes can be delivered through well-planned development;
  • national and local government needs to consider the particular powers, resources and expertise that planning services require;
  • in both research and policy, the value of planning needs to be analysed to understand how its economic, social and environmental benefits can be maximised.

The report argues that planning authorities are in a good position to exercise leadership, and to think about places in ways that the private sector often cannot:

  • bringing together agencies, government bodies and service providers, to identify and deliver the best long-term outcomes across different policy areas;
  • setting and enforcing high standards of building design;
  • providing for public and green spaces to enhance the attractiveness of an area to residents, businesses and visitors;
  • removing risks and obstacles to development, such as contaminated land.

In the midst of a national housing shortage, the report calls for a stronger role for public sector-led developments, pointing to examples of good practice in Manchester, Norwich and Birmingham which have delivered more and better housing and development.

Realising the potential of planning

The RTPI report reinforces the planning profession’s strong conviction that planning is a solution, rather than a problem.

 “If the full benefits of planning are truly to be realised, we need reforms that exploit its true potential to reconcile economic, social and environmental challenges through positive and collective action, and which confront those sectoral interests that seek only short-term, self-interested solutions.”

Can the NPPF be used to encourage better design? A look at a recent High Court decision…

A recent High Court decision has significant implications for interpreting the design policies in the National Planning Policy Framework (NPPF) and the National Planning Policy Guidance (NPPG).

Handing down the decision in Horsham District Council v. Secretary of State for Communities and Local Government (1), Barratt Southern Counties Limited (2) on 23rd January 2015, Mr Justice Lindblom stated “It is not a general principle in planning law that an acceptable proposal for development should be turned away because a better one might be put forward instead”, dismissing the notion that this principle had not persisted with the introduction of the NPPF.

The case revolved around the question of whether an inspector had failed to take account of whether a better designed scheme could be conceived for a development site.

The Court dismissed an application under section 288 of the Town and Country Planning Act 1990 by Horsham District Council for an order to quash the decision of the inspector – appointed by the first defendant, the Secretary of State for Communities and Local Government –  to allow the appeal of the second defendant, Barratt Southern Counties Limited (“Barratt”), against refusal of planning permission for a development of 160 dwellings on land to the north of West End Lane in Henfield, West Sussex.

The Council had contested the grant of planning permission. During an inquiry the council submitted that the proposed development was a poor design which obscured views of the landscape, that a well-designed scheme should contain view corridors to retain these important views, and that it was fundamental to the principles in the NPPF regarding good design and the need to incorporate development into the character of the area, that such a scheme should preserve these views.

The inspector concluded that the likely “adverse environmental effects” of the proposed development were “limited” and did not outweigh “the considerable social and economic benefits” with respect to the early provision of new homes in circumstances of a local shortfall. He considered that policy in the NPPF did not indicate that the development should be restricted, and that the development would therefore be “sustainable”, and “the presumption in favour of such development should be applied”.

The Council argued that the inspector was not entitled to grant planning permission for Barratt’s proposal while it was still possible for a scheme to come forward in which long views from the site would be better protected, in light of policy set out in paragraph 64 of the NPPF that “permission should be refused for development of poor design that fails to take the opportunities available for improving the character and quality of an area and the way it functions.”

In his ruling, Mr Justice Lindblom stated that the NPPF does not say that a proposal which does not take every conceivable opportunity to enhance the character and quality of an area, or which does not deliver as well in this respect as a different proposal might have done, must therefore automatically be rejected.

He noted that the inspector focused on the policy in paragraph 64, as well as the wider policies on the design of development within which that paragraph is set, and that he exercised his own judgment on the issues relating to “good design” and “poor design” in light of these policies, concluded firmly that the proposal was not of “poor design”, and brought that conclusion into the comprehensive assessment of the planning merits on which he based his decision.

Referring to the decision in First Secretary of State and West End Green (Properties) Ltd. v Sainsbury’s Supermarkets Ltd., Mr Justice Lindblom stated that in this case, the fact that an alternative approach could have been adopted in the design of the development, and that this could have maintained some views from the site which would have been obscured by Barratt’s development, did not mean that the design of the proposal the inspector was considering contravened government policy in the NPPF.

The judge went on to state that the inspector was entitled, and in fact, required, to exercise his own judgment on whether the scheme constituted poor design under the NPPF, and that he did so in an entirely lawful manner, applying NPPF policy appropriately. He noted that, “It may be that the council disagrees with him, but such disagreement is not ammunition for a legal challenge.”

The Court also reiterated the principle that an application under section 288 of the 1990 Act does not afford “an opportunity for a review of the planning merits” of an inspector’s decision.

This case indicates that an acceptable scheme cannot be rejected to encourage an improved scheme, given the design policies of the NPPF and the NPPG.

Today’s announcement that Bicester is to be the second new garden city with 13,000 new homes, is a reminder that the UK’s housing shortage requires large-scale solutions. According to the Town and Country Planning Association’s estimates, between 240,000 and 245,000 new homes are needed each year up to 2031 to meet the needs of our growing population. This demand can only be met by building new settlements including schools, transport links, infrastructure and community facilities. Continue reading

Loosening the belt: the debate over building on green belt land

“The green belt has been exalted as sacrosanct in a way in which almost no other policy area has been indulged, and any attempts to have a serious conversation about its development have been swiftly stifled with the same kind of force as would usually be reserved for suggestions to entirely dismantle the NHS.”

So said Andrew Carter, the Acting Chief Executive of Centre for Cities, writing on the Conservative Home website earlier this month. It’s true that green belts have long been regarded as untouchable. But there are signs that the bulletproof shield protecting them could be breaking down.

In September, the Wolfson Economics Prize went to regeneration consultancy Urbed for its proposal to create a city of 400,000 people by doubling the size of an existing town and building on the surrounding green belt. The following month, Rowan Moore, The Observer’s architecture critic, considered the arguments for and against green belts and concluded:

“…it is no longer good enough to insist that green belts must, at all costs, never change.”

Meanwhile, defenders of green belts have been voicing their concerns. “A weakening of protection for green belts would lead to urban sprawl over precious countryside and farmland,” said the Council for the Protection of Rural England (CPRE), launching its campaign for a stronger commitment from government to review the latest threats to the green belt. And after the Wolfson prize winner was announced, architect Richard Rogers spoke out against Urbed’s proposal to take a bite out of the green belt, calling it “a ridiculous concept.”

The idea of curbing urbanisation is not new. During the reign of Queen Elizabeth I, a three-mile wide belt around London was proposed in order to stop the spread of the plague. More recently, the garden city movement’s ideas about urban and rural areas, led to the 1947 Town and Country Planning Act, which allowed local authorities to include green belts in their town plans.

Today, there are 14 green belts in England, 10 in Scotland, 30 in Northern Ireland and one in Wales. They exist as buffers between towns and countryside, and successive governments have ensured that they are maintained. The UK government’s latest National Planning Policy Framework sets out the green belt’s five purposes:

  • to check the unrestricted sprawl of large built-up areas;
  • to prevent neighbouring towns merging into one another;
  • to assist in safeguarding the countryside from encroachment;
  • to preserve the setting and special character of historic towns; and
  • to assist in urban regeneration, by encouraging the recycling of derelict and other urban land.

Historically, green belts have been regarded as one of Britain’s great planning successes. But there has been growing criticism of the costs of the green belt, typified by Rowan Moore’s observation:

“It stops cities expanding, which had previously done so for centuries. It contributes to the scarcity and cost of decent homes in large parts of the country. It encourages bizarre and wasteful patterns of commuting. It often fails in its original aim of providing accessible recreational space for city dwellers. It is enforced with a rigidity that makes little sense, except as a sign of mistrust.”

Britain’s housing crisis has amplified calls for the green belt to be breached.  Government projections suggest that the UK needs six million new homes in the next 30 years. Proponents of building on green land contend that existing urban and brownfield areas alone cannot cater for the housing demand, an argument underlined by Urbed in its submission to the Wolfson competition.

Centre for Cities has claimed that building on 5.2% of green belt land within and around Britain’s least affordable cities would deliver 1.4 million new homes.

Their opponents disagree. This month, the CPRE reported that a minimum of 976,000 new homes could be built on identified brownfield sites in England, and that the supply of these sites is steadily increasing. The organisation has also suggested that housebuilders are “sitting on huge areas of land with planning permission which could provide over 280,000 new homes.”

With a general election on the horizon, the main political parties have been drawing up their battle lines. The Labour Party is showing signs of greater flexibility on the green belt issue. In October, Sir Michael Lyons published the final report of his independent review of housing for the Labour Party. One of his recommendations included allowing more homes to be built on parts of the protected green belt if the land has little “environmental or amenity value”. In response, the Conservative Party has reiterated its commitment to protecting the green belt.

Perhaps most interestingly, it’s at the local level that changing policies on green belts can be most clearly seen. Councils in England are responding to the housing crisis by using localism powers granted to them by the coalition government to de-designate or swap greenbelt land in the context of making a local plan. Figures published in August by Glenigan planning and construction consultants revealed that 5,600 new homes were approved to be built on green belt land last year, a 148% increase on the 2,260 green belt homes in 2009/10.

The debate now seems to be moving towards a recognition that some infringement of green belt land is inevitable, which is perhaps why a recent commentary on the subject by an academic from the London School of Economics was not titled, “Why should we build on the green belt?” Instead, it was headlined: “Where should we build on the green belt?”.
